These terms and conditions (the "Terms") are the service agreement that the parties agree to be bounded and governed for the Client’s use of and participation in the identification and authentication services and other related transactions provided by Binance Thailand (the "Service Provider") (hereinafter referred to as the "Digital ID Services" or “NDID Services”). The Digital ID Services are provided by the Service Provider via the identification and authentication system/platform (“Digital ID Platform”) powered by National Digital ID Co., Ltd. ("NDID") in which there are the policies and conditions of the usages of the Digital ID Platform (the “NDID’s Policies and Conditions of the Usages”) specified and described by NDID as shown on NDID’s website: [https://www.ndid.co.th/termandcon.html]The Client acknowledges and agrees that, by accepting the Terms, the Client agrees that the Client has read, understood, and agreed to be bound by these Terms and NDID’s Policies and Conditions of the Usages. If you do not agree with such agreements, please do not access or use the Digital ID Services.
The Client acknowledges that to be eligible to use the Digital ID Services, the Client must have enrolled/verified Client’s identity to the other service providers (the "Identity Provider" or “IdP”) under which the Client has entered into a separate legal relationship that has terms similar to this Terms.
Upon the Client's request for the Service Provider's Digital ID Services, the Client agrees to the Service Provider as follows:
The Service Provider is entitled to rely on the Client's identification and authentication process performed by other Identity Provider via Digital ID Platform;
The Service Provider is entitled to collect, obtain, use, process and store the Client's personal data from relevant authoritative sources;
When the identity authentication for the enrollment process by the Identity Provider and data access authorization by the authoritative sources are completed, the Client agrees to provide the permission through the Service Provider for the authoritative source to release the Client's personal data to the Service Provider pursuant to the Service Provider's privacy policy/notice. The Client acknowledges and agrees that if the Client refuses to provide the permission for the authoritative source to release personal data of the Client to the Service Provider, the transaction cannot be further processed and the Service Provider may not be able to provide the product or services so requested by the Client.
The Service Provider may agree or refuse to proceed with the Client's application for the Digital ID Services if either the identity authentication by the Identity Provider, data access authorization, or provision of the Client's personal data by the authoritative sources cannot be completed for any reasons pursuant to the applicable requirements.
A successful application for the Digital ID Services shall be dependent upon the identity authentication by the Identity Provider, data access authorization, and provision of the Client's personal data by the authoritative sources.

The Client acknowledges and agrees that NDID only provides the Digital ID Platform of which it facilitates the data to be transmitted and/or stored the data logs between the members of NDID in accordance with the terms and conditions of NDID. However, NDID cannot access to and/or interfere with the actual information exchanged between NDID's members.The Client further acknowledges and agrees that the members of NDID who takes part in the Digital ID Platform may transmit and/or store the data logs, in accordance with the above mentioned paragraph. However, the data logs may consist of the data relating to any transactions processing on the Digital ID Platform. Such data shall not be able to identify the owner of the data.

The Client acknowledges and agrees that any agreement (including any claims and liabilities) between the Service Provider and the Client arising in connection with the Service Provider's products and services shall exclusively be between the Service Provider and the Client. The Service Provider shall be directly liable for any products and services offered to the Client. NDID shall not be responsible for the Service Provider's products and services. Furthermore, the Client acknowledges and agrees that neither NDID, nor its directors, shareholders, employees, or agents shall be held liable for any loss or damage, whether direct, indirect, consequential, exemplary, punitive, or incidental, including loss of profits and loss of goodwill, incurred to the Client and/or any other person as a result of or due to the provision of NDID’s services.

The Client agrees to be bound by the Digital ID Services and/or any other transactions made or executed via the Digital ID Platform.

The Client represents that all the information and documents (including their copies) provided to the Service Provider (if any) for identification and authentication and/or authorization is true, correct, complete, and up-to-date, and that the Client has the authority and competence to apply for and use the Digital ID Services, including to perform any and all transactions in connection with the Digital ID Services.

The Client agrees to provide the Service Provider with any additional information upon request and/or to keep such information updated and immediately notify the Service Provider upon any change thereof.

The Client acknowledges and agrees that the Service Provider may collect and use the information provided by the Client which includes personal data e.g. biometric data (for example: finger prints, facial recognition) for the purposes contemplated in and/or under the contract between the Service Provider and the Client.In addition, the Client acknowledges and agrees that, to perform any actions pursuant to the terms and conditions prescribed in the contract which the Client is a counterparty, the Service Provider may disclose the Client’s information as mentioned in paragraph one to other service providers, NDID, any of NDID’s members, and/or other third persons for data verification, identification and authentication, authorization, and other related transactions.
